1.      Pledge of Allegiance 

 

        Chair Sheffield called the meeting to order at 6:00p.m. with a quorum and then led  

         in the Pledge of Allegiance to the U.S. Flag.

 

2.      Introduction of Members/Roll Call

 

Each member present stated his or her name and district for the record.

 

3.      Approval of Minutes – July 12 & August 30, 2012  

 

Minutes were not approved at this meeting.  The July 12 should be corrected to reflect on                                  page 4 of 9 in Policy 5.2.22, the Policy number as defined should be 5.31 instead of 5.31.1 and when copied all even pages were not printed.  The August should have the addition of items mentioned by Commissioner Allen on Data Analysis.

Deputy Clerk Wood commented she would do her best to have the ready for the turnaround date of next week, October 18, 2012.

5.      Public Hearing – Hutchinson Ferry Road Proposed Small Scale Map Amendment –for parcel identification numbers 2-15-3N-4W-0000-0011400 and 2-14-3N-4W-0000-00230-0500. 

 

Mr. Matheny discussed the Future Land Use Map Amendment that is proposed to change the Future Land Use Category from Agricultural 2 (AG-2) to Rural Residential (RR) on approximately 10 acres of land.   He said David Brown and Walter and Shirley Stanley, Jr., represented by Peter Okonkwo of Spectra Engineering & Research, Inc. have requested the small scale amendment. 

 

This action is considered a quasi-legislative action (policy formation) in conjunction with the advertised public hearing as a small scale amendment (less than 10 acres) to the Future Land Use Map (FLUM) per Subsection 7401.A.2 of the Gadsden County Land Development Code (LDC) and Chapters 163.3184 and 163.3187 (1) (c), Florida Statutes.  At this public hearing, the Planning Commission is requested to make recommendation to the Board of County Commissioners (BOCC) for transmittal of a FLUM amendment to the Florida Department of Economic Opportunity (DEO), Division of Community Planning (DCP).

 

He said the subject properties are located on the north side of Hutchinson Ferry Road (CR 272), approximately 100+ ft. east of Sims Road and 0.4 miles west of Bainbridge Highway (SR 267).  The subject parcels are designated AG – 2 and are located in Township 3N, Range 4W, Section 15 (Attachment #1).  The parcels access Hutchinson Ferry Road, a minor collector roadway.  The AG-2 Future Land Use Category requires that conforming residential parcels have a minimum area of ten (10) acres.

 

Commissioner Ganus asked about it be an unlawful subdivision of the land.

 

Mr. Matheny said it happened a lot in the past.

 

Commissioner Ganus asked Mr. Matheny to have a working relationship with the Clerk’s Office. He also asked had there been any clearing on this property.  He said there was suppose to be 5 lots on the 10acres, could not find 5, the most I can find is 3.  He asked is that still a valid plat.  He discussed the Conceptual Plan.  He questioned the In Rural Residential he said it has some creditability.

 

Commissioner Ganus asked applicant what long term plans for use of land.

 

Mr. Brown said that he plans to put no more than 5 homes on the property.

 

Commissioner Allen asked about the flood zones.

 

Mr. Matheny would have to have proper setbacks.

 

Commissioner Sheffield asked how many homes where minor.

 

Mr. Matheny said with site built homes it is 7, mobile homes 5.

 

Mr. Matheny said it would go the BCC for adoption. It is a lot simpler than a major subdivision.

 

UPON MOTION BY COMMISSIONER DAVIS AND SECOND BY COMMISSIONER DR. GAIL BRIDGES – BRIGHT, THE COMMISSION VOTED 9 – 0, BY VOICE VOTE,  TO APPROVE A ‘DRAFT’ ORDINANCE FOR THE HUTCHINSON FERRY ROAD ADMINISTRATIVE FUTURE LAND USE MAP AMENDMENT (CPA -2012-02) TO AMEND THE ADOPTED FUTURE LAND USE MAP BY CHANGING THE LAND USE CATEGORY ON TWO (2) PARCELS (PARCEL I.D. #’S 2-15-34W-0000-00114-0400 & 2-14-3N-4W-0000-00230-0500) TOTALING TEN (10) ACRES FROM AGRICULTURAL 2 (AG-2) (1:10) TO RURAL RESIDENTIAL (RR) (1:1) BASED ON THE ABOVE LISTED FINDINGS AND A DETERMINATION OF CONSISTENCY WITH THE COMPREHENSIVE PLAN.
