1.     PLEDGE OF ALLEGIANCE

 

                                Chair Sheffield called the meeting to order at 6:00p.m. with a quorum and led in the                                    Pledge of Allegiance to the U.S. Flag.

 

2.     INTRODUCTION OF MEMBERS/ROLL CALL  

 

                                Each member present stated his or her name and district for the record.

                               

3.     APPROVAL OF MINUTES – DECEMBER 13, 2012 – passed until next meeting.

 

4.     DISCLOSURES AND DECLARATIONS OF CONFLICT - None

6.     Amendment to Agenda -   Policy 1.5.1

7.     PUBLIC HEARING – UNITED NEW JERUSALEM CHURCH OF JESUS CHIRST – PROPOSED VARIANCE (VE-2013-01) FOR PID# 2-11-3N-5W-3123-20000-0020.  

A Public Hearing to consider a Variance to allow United New Jerusalem Church to access U.S. 90 as opposed to Orchard Road. The variance is proposed for property located on the south side of U.S. 90, approximately 1.76 miles east of Atwater Rd. and 1.29 miles west of Hazel Green Rd. Mr. Matheny addressed the Board.

 

   Ganus – referenced page 2

Simmons – He said the only sensible entrance access point is Hwy 90.

   Carmen Green- we want two access points.  We would like to come through the County and get variance.

Sheffield – On the plat there is a storm water pond.

Green- Developing alternatives, severe access. Stormwater Pond will be moved.

 

Simmons/Ganus – 11-0 passed

 

8.     PUBLIC HEARING – Proposed Ordinance to add a new Subsection 7003 to the Gadsden County Land Development Code adding language to allow the Planning and Community Development Department Director additional flexibility and discretion regarding development and to revise Subsections 1203 and 1206 of the Gadsden County Land Development Code (LDC) as indicated in the Ordinance title.  

 

Tranchand – I struggle with this one. He listed concerns. I worry about protection for you as the Director.

Ganus -  Number of items that could be out of compliance.

Matheny – It could happen, but normally it’s only one.

Ganus – pg3 of ordinance (b & c); sounds big and pretty awesome.  You are asking for more troubles. Not in favor of this action, he would like section b being struck.

Matheny – Rare concern, it would probably be declared by the Board of County Commission like a local emergency.

Simmons – Was not in favor of the added authority. To vague, too much conflict.

Davis – Filing fee for variance.

Matheny -$750

Dixon- There is a problem with ratification We don’t won’t to undo what the Directors is doing, but if you give him 5,10,15 whatever the Board chooses and he operates within. I would like to know he has protection.  

Davis –

Matheny – Very rare if we give anyone anything. If it is a inch.

Davis – What number are you comfortable with.

Bridges-Bright – I like Collier County. I agree with some discretion.

Matheny – I could make same amount, just clearer.

Chukes – if we allow to; he can give waivers or recommendations.

Matheny – no reporting day to day administration functions.

Davis – Annual reports in favor. Remove section b(local economic emergencies)

Ganus – this seems to be after the fact.

Matheny – if we could start with Collier County.

Bridges-Bright – we want to allow 5, 10,15 before, during or after.

  Marion Lasley -5 Dante Court – I don’t think these cities listed are rural.  She stated in the Ordinance non- residential uses. I think public and Board should have input. He needs to be accountable to someone. Rewriting code is a bad idea, it needs to benefit all in the county. Not in favor of approving ordinance. I suggest they change fee schedule, set minor variances.  It could be dealt with in another way.

 

Allen – when you give variance, is there something in writing.

Matheny – only notes, nothing in writing.

Bridges-Bright – matter of public record. Yes

 

Matheny -“To make it more a standard practice.” Fee schedule has been by Board.

   Motion: Sheffield/Bridges-Bright 6-5 carries (Ganus, Vanlandingham, Allen, Simmons, Dixon - opposed) Collier County model 5, 10, 15 before, during or after; remove section b. Ordinance 2013 read into record.

 

 

9.     PUBLIC HEARING – Proposed Ordinance to amend Section 6600, Immediate Family Exceptions, Section 6600.A Deeds of Gift or Inheritance, Section 6600.C Deed of Gift or Inheritance, Section 6600.C Deed Restrictions to allow immediate family properties to be sold outside of the immediate family after an adopted period of time.  Five (5) years is proposed.  

Ganus – it should be tighten up and make sure property is deeded properly.

Sheffield – Homesteaded property wording should be taken out.

Matheny – remove homestead requirement.

Public Comment – Marion Lasley – County Commission has monies to redo Land Development Code and Comp Plan, why is this not included.

Matheny – He said they don’t have funds yet, updates are coming. To work on minor revisions, hopefully in July we farther funding we can get major revisions done.

Motion: bridges – Bright/Ganus – 10-1 (Ganus opposed) remove wording Homestead property

 

10. PUBLIC COMMENT – None

10.A    Policy regarding Comp Plan- Ear Amendments None We put in both or take out both-  Ganus – place on next agenda.

 

Matheny –  Commissioner Allen is saying Commission agreed to do away with non-conforming uses. He suggested that he and Mr. Allen meet with Mr. Lawson one day next week.

 

Consensus – for Comm. Allen and Mr. Matheny to meet with Mr. Lawson to discuss Commissioner Allen’s concerns.
