1.                  PLEDGE OF ALLEGIANCE

Chair Davis called the meeting to order at 6:00 p.m. with a quorum present. She then led in the pledge of allegiance to the US Flag and asked each person to silence their electronic devices for the duration of the meeting.

 

2.                  ROLL CALL

              Each member present stated his name and district for which he represents.              

 

3.                  APPROVAL OF  THE AGENDA – Bright/Bridges 7-0

             

 

4.                  APPROVAL OF MINUTES –  February 11, 2016  

Lasley comments – table comments not presented at the meeting.

Dixon/ Bright 6-0 motion passed

Lasley – opposed minutes (because she was not present & had requested that information be submitted)

 

PUBLIC HEARINGS

 

5.                  PUBLIC HEARING (Legislative) (LDR 2016-02) - Consideration of amendments to Chapter 2, Definitions and Interpretations, and Chapter 6, Subdivision of Land of the Land Development Code.  [POSTPONED]  

 

 

6.                  PUBLIC HEARING (Legislative) (LDR 2016-03)- Consideration of amendments to Chapter 1, Administration and Enforcement and Chapter 7, Development Orders, Development Permit and Development Agreements of the Land Development Code .  

 

This hearing is required to offer a recommendation to the BOCC for the amendment of Chapter 1 and Chapter 7 of the Land Development Code as to the consistency of said amendments to the Comprehensive Plan.

 

As the Planning Division has been working on updates to the Land Development Code to not only to be consistent with the Comprehensive Plan, but to update procedures and regulations to current standards and Florida law, and to have a more clearly concise document.

 

Commission Discussion:

 

  The biggest change came from Chapter 7 to Chapter 1 to section 1700:

  Bright page 1 of 7: Change order of sentence

  Nunamaker asked about 2nd public meeting.

 Bright: Change sentence flow for continuity.  

  Nunamaker page 5 -1700: variances. Should be coma added.

  Bright 6 of 7: question about applicant being made to pay for mail outs. Who is paying for it?

  Lasley commented on red strike out in middle of page: Growth management

They can have issue raised under 6.  Part A Any issues raised a CBOR must be presented to staff and transmitted to the Planning Commission and BOCC.

  Lasley commented whenever Citizens get together, want voice heard about the project.

  Weiss said they should not start adding things that don’t have to do with notice. Under A: add 15 days & take out 5.  Reorganize and maybe put it in B. Variance piece can be placed somewhere. Want to recommend something that

  Lasley suggested maybe they should use language if applicable.

  Dixon commented on political position.  

  Davis sections A needs to be modified and 15 days to the 1st sentence. Section6 that deals with transmitted and revised and be brought back at the next meeting.

  Bright on page 7 recommends that they not have a supermajority vote.

  Lasley asked is it part of Plan or Development Code. Code

  Davis – Lasley in favor of retaining Supermajority. Dixon – creates unnecessary burden – agree with Bright;   Supermajority favor – Lasley and removed Dixon, Milton, Bright, Nunamaker and Chukes to remove.   Lasley commented why she was not in favor of removing supermajority, she was in favor of sound planning.  Dixon

  Davis 6-1 Lasley opposed

  Lasley page 7: F & G, struck entirely.

  Dixon said they we used urban service to get around the Comprehensive Plan.

  Weiss suggestions: make on page 6: At least 15 days: Planning Division: B     

  Milton asked that the Attorney forward information to the Director.

  Lasley asked why B 1-3 was deleted.

We issue a development order for anyone in the County. It is unnecessary information. I didn’t understand it makes no sense.

  Weiss stated it was irrelevant, not necessary language.

  page 3 of 9:  Exemptions Lasley – duplex, triplex, quadraplex (Not in favor)

Gutcher - Can be on one parcel, not anything exceeding 5000 square feet in impervious area.

  Lasley said let’s be more specific. The neighborhood would change. Speaking on single family homes.

  Davis any other Commissioner’s have any comments of B 1 and there were no additional. She then took vote.  Nunamaker – I would like to see examples of how this would reflect other areas. Lasley – I would like for you to take and tell me where they would be applicable. Nunamaker – In rural residential it could go on rural residential, not Ag. Land.  Gutcher – we have to regulate structure, not ownership.

  Lasley where they can be put.

  Davis –

  Dixon commented on mixed use housing.

  Lasley term used in Land Development. It is a reality of the Code.

  Nunamaker said he was concerned with the density.

  Gutcher said there was  no policy in the plan

  Davis said she would like a layout of duplex, triplex, and quadraplex.

Nunamaker said he would back off his request.

  Davis said she was in favor of language 6-1 Lasley opposed of language as is.

  Gutcher – you can’t say a Commission will change Land Category.

  Lasley asked why where sections 7704 a-d deleted.

  Weiss said it was redundant, no need to reference.

  Davis said wait for change or approve with changes that have been discussed.

Bright/ Dixon 6-1 opposed by Lasley

7.                  PUBLIC HEARING (Legislative) (LSA-2016-02) - Consideration of text amendments to Policy 1.1.1G and Policy 1.1.1.H of the Future Land Use Element of the Gadsden County Comprehensive Plan to allow solar power generating facilities in the Agriculture 2 and Agriculture 3 Future Land Use categories.   

 

This hearing is required to offer a recommendation to the BOCC for the amendment of Chapter 1 and Chapter 7 of the Land Development Code as to the consistency of said amendments to the Comprehensive Plan.

 

As the Planning Division has been working on updates to the Land Development Code to not only be consistent with Comprehensive Plan, but to update procedures and regulations to current standards and Florida Law, and to have a more clear and concise document.

 

This provision will make it allowable and make it consistent with the Comp Plan before moving to BOCC.

 Davis – New Language discussed.
