Chair Henderson announced the commission did not achieve a quorum.  Therefore,  it would proceed as a workshop only at which it would not conduct general business. .

CHAPTER 4, Land Use Categories (Legislative) (LDR 2018-05)

Suzanne Lex – reported that a paid consultant was hired to update the Land Use Code.  However, she was unable to finish the work.   Ms. Lex picked up from where the consultant left off.  Today provided F, G, H.

 

Agriculture 1; Agriculture 2; and Agriculture 3 become the zoning districts.

 

Section A – Introduction

Section B- Bulk regulations – immediate family exception – Lex to look at current min standards; trends in other part of state.

  Lori Bouie – would like to see a smaller lot sizes in family exemptions if other state regulation will support the smaller size (water and septic)

    Tracey Stallworth – wants to see what other counties are doing with family exemptions.

B3 Agri/Agro –?  Are they interchangeable

#6 – needs period after it.  Add acreage of each Ag category

Products grown locally – concern for 2,000 sq. ft.  proportionally grow with the acreage

 

  Look at indoor and outdoor standards for produce stands.  

Why permit the size of a barn if it is structurally sound and is permitted?

It is technically a commercial venture. 

 

8,9,10,11 –Commercial feed lot?  It is not defined, but is referenced here.

 11 – solar farm

 

10 -    clarify that it is a minor development review – in Chapter 7   make this #8

 

Riding academy – In Chapter 2, there was exclusion for boarding stable.  Does this conflict with Chapter 2?         Is this a good for Gadsden County? 

 

  Marion – dog kennel – only allowed in Ag 2 & 3.

 

  Nunamaker  - in Ag 2 with 9.5 acres.  He brought in 20 dogs.  He has ruined the sanctity of the neighborhood.  They bark incessantly.  Ms. Lex will see if it is addressed in other parts of the Code. Look in Animal control section.  May need to change this to 20 acres.

CHAPTER 2, Definitions and Interpretations (Legislative) (LDR 2018-06)

   Suzanne Lex  #11 on August 22 meeting. 

 

Nunamaker:   Why  strike abut and abutting?   Trying to be consistent with use of the term adjacent.  Other parts of the code use adjacent and  not abut.  The definition of “adjacent” should include the term abut and abutting. If it is touching, it is abutting.  Not all adjacent parcels are abutting.    Put abut/abutting  back into the definition.

 

 Nunamaker:  Access, legal – access is a matter of fact;  legal is a law.   Choose another word

  Attorney David Weiss  gave explanation of legal access explaining that the purpose this case is to be able to determine if you can develop a particular lot. He advised to leave the definition simple and address other issues in other places in the code.   There may be a non recorded legal access. 

  adverse impact – on site and off site impacts – this comment was added by the board of county commissioners

  active recreation -   Marion Lasley: Don’t leave a loop hole for degrading environmental impacts. Put all the recreation together and look at it as a whole  

 

We know what passive recreation is – active should be everything else. 

  Alcoholic beverage –

 

  Bed & Breakfast.

 

Auto grave yard, junk yard, etc.  put them all together.  Look at them as a whole. 

Perhaps there is a common term that can be used.

 

Bar/tavern/night clubs is another incident. 

 

  Domestic Animal – do not list types.
